Federal agents do not have unlimited power to search laptops and other electronic devices without a warrant at the border, including airports, a federal judge in Washington said.

U.S. District Judge Amy Berman Jackson rejected prosecutors’ arguments that a laptop was like any other container that could be searched at the border without a warrant. The “border search doctrine” had limits when it came to electronic devices, Jackson wrote.

At this stage, a sane person might be tempted to call it a day on the monetary experiments, especially considering that at this point, the limits have been reached. That is, there are literally no more assets to buy and rates have hit the effective lower bound where rational actors will eschew bank deposits in favor of the mattress. But not so fast, say folks like Citi’s Willem Buiter and economist Ken Rogoff: the world could always ban cash because if you eliminate physical currency and force people to use a debit card linked to a government controlled bank account for all transactions, you can effectively centrally plan everything. Consumers not spending? No problem. Just tax their excess account balance. Economy overheating? Again, no problem. Raise the interest paid on account holdings to encourage people to stop spending.

The U.S. government is becoming less transparent than it has been at any time in our history, as evidenced by pending water legislation in the nation's capital that voters, via their elected representatives, are not permitted to see.

As reported by McClatchy Papers, five months into a new Congress and years into a punishing drought that still continues to ravage most of California, legislation dealing with dwindling supplies of water confounds and splits the state's lawmakers.

JPMorgan’s Jamie Dimon Deals With His Bank’s Felony Charge – Badly

Against this backdrop of a serial crime spree on the part of employees on multiple continents and coast to coast in the United States, JPMorgan released a statement yesterday regarding the bank pleading guilty to a felony charge for engaging in the rigging of foreign currency trading, calling it “principally attributable to a single trader.” In the statement, Dimon says the bank has a “historically strong culture.”

U.S. government attempts to inform consumers about the origins of the beef and pork they purchase in stores have been undermined by the World Trade Organization (WTO). Siding with officials from Canada and Mexico, the WTO ruled that American regulations that require the meat industry to use country of origin labels (COOL) represent a violation of the North American Free Trade Agreement (NAFTA). COOLs are intended to tell shoppers in which country the meat they buy was born, raised and slaughtered. In addition to letting consumers know if the meat was produced locally, they gave regulators a way to begin tracing the meat in case of a problem with it.

The National Security Agency and its closest allies planned to hijack data links to Google and Samsung app stores to infect smartphones with spyware, a top-secret document reveals.

The surveillance project was launched by a joint electronic eavesdropping unit called the Network Tradecraft Advancement Team, which includes spies from each of the countries in the “Five Eyes” alliance — the United States, Canada, the United Kingdom, New Zealand and Australia.

The top-secret document, obtained from NSA whistleblower Edward Snowden, was published Wednesday by CBC News in collaboration with The Intercept. The document outlines a series of tactics that the NSA and its counterparts in the Five Eyes were working on during workshops held in Australia and Canada between November 2011 and February 2012.

CYF in child abuse predictor trials

Model pools data from across departments to forecast most at-risk children — but some experts are cautious.

A mathematical model designed to predict children at risk of abuse will be trialled with data about children reported to Child, Youth and Family.

The model predicts which children will suffer substantiated child abuse or neglect based on 132 factors drawn from cross-departmental records, including the parents' ages, their criminal records, their own history of being abused as children, and recorded family violence.

Initial testing by the Social Development Ministry, looking at the 5 per cent of children born in 2007 who would have been rated at highest risk in the model, found that 31 per cent suffered substantiated maltreatment by age 5. That figure was projected to rise to 40 per cent by age 10, but still meant 60 per cent would have been targeted unnecessarily ("false positives").

The official White House website includes the President George W. Bush historical archives. On top of the page is a message that notes "This is historical material, "frozen in time." The web site is no longer updated and links to external web sites and some internal pages will not work." This particular press conference was held on March 13, 2002, a mere six months after the purported "terrorist" attacks of 9/11/01.

In it, Bush was asked "Mr. President, in your speeches now you rarely talk or mention Osama bin Laden. Why is that? Also, can you tell the American people if you have any more information, if you know if he is dead or alive?"
Bush replied "Deep in my heart I know the man is on the run, if he's alive at all. Who knows if he's hiding in some cave or not; we haven't heard from him in a long time. Terror is bigger than one person... I'll repeat what I said. I truly am not that concerned about him."

Maybe It's Time To Just Cuss Them Out (Really Fed-Up Driver unleases tirade at Rogue DHS agemt)

What do you do with a lawless, criminal rogue government with no chance of reform? Maybe it boils down to just cussing them out.

Despite this, rogue Department of Homeland Security agents continue to ignore the law, the Constitution, and U.S. Supreme Court rulings. In a recorded exchange at the notorious Laredo, TX warrantless checkpoint yesterday, this prompted a fed-up driver to unleash a profanity-laced tirade against the obnoxious agent, demanding the officer's supervisor. Two supervisors came rushing up, one recording the scene with a video camera attached to an extension pole.

FLASHBACK - THE LIE OF THE (LAST) CENTURY

It is inescapable historical reality that leaders of nations will lie to their people to trick them into wars they otherwise would have refused. It is not "conspiracy theory" to suggest that leaders of nations lie to trick their people into wars. It is undeniable fact.

This brings us to the present case.

Did the government of the United States lie to the American people, more to the point, did President Bush and his Neocon associates lie to Congress, to initiate a war of conquest in Iraq?

This question has been given currency by a memo leaked from inside the British Government which clearly indicates a decision to go to war followed by the "fixing" of information around that policy. This is, as they say, a smoking gun.

But the fact is that long before this memo surfaced, it had become obvious that the US Government, aided by that of Great Britain, was lying to create the public support for a war in Iraq.

Shoppers could soon have a harder time finding out where their red meat comes from.

The World Trade Organization ruled Monday that the U.S. "country of origin" labels put Canadian and Mexican livestock at a disadvantage. The current labels say where the animals were born, raised and slaughtered.

The Obama administration has already revised the labels once to try to comply with previous WTO rulings in favor of Canada and Mexico. Since those efforts didn't work, Agriculture Secretary Tom Vilsack says Congress will have to weigh in to avoid retaliation — such as extra tariffs — from the two neighbor countries.

How obeying the law will no longer be enough to protect you from the police

Even if you are not suspected of committing any crime, you could be hit by orders preventing you from speaking in public or associating with specific people.

The planned "snooper's charter" will give the police the right to read your private messages, even if you're not suspected of any wrongdoing. Now, it seems that if they see anything they don't like (even if it isn't criminal) they won't be obliged to leave you alone.

SOPA, anyone? Entertainment Lobby Uses Hearing on Domain Names to Revive Awful Censorship Idea

Amidst a discussion of new top-level domain names (such as “.sucks”), a lawyer representing the Motion Picture Association of America (MPAA), the Recording Industry Association of America (RIAA), and other groups told the House Judiciary Committee’s Internet subcommittee that ICANN should force the companies that register domain names to suspend domains based on accusations of copyright infringement.

If this sounds familiar, that’s probably because it’s exactly the sort of system that the disastrous SOPA bill would have created—one where entire websites can be forced to go dark, without a day in court, because some material on the site is accused of infringing a copyright.

UK government quietly rewrites hacking laws to give GCHQ immunity

The UK government has quietly passed new legislation that exempts GCHQ, police, and other intelligence officers from prosecution for hacking into computers and mobile phones.

While major or controversial legislative changes usually go through normal parliamentary process (i.e. democratic debate) before being passed into law, in this case an amendment to the Computer Misuse Act was snuck in under the radar as secondary legislation. According to Privacy International, "It appears no regulators, commissioners responsible for overseeing the intelligence agencies, the Information Commissioner's Office, industry, NGOs or the public were notified or consulted about the proposed legislative changes... There was no public debate."

The War On Cash Destroys A Small Entrepreneur

Banks are legally obligated to report any deposit of more than $10,000 to the U.S. Treasury Department. But if an individual makes several cash deposits of less than $10,000 over an unspecified period of time that total more than $10,000, then he is presumed to be a money launderer or drug trafficker who is committing the dastardly crime of structuring, that is, seeking to circumvent the bank’s reporting requirement and maintaining the privacy of his financial affairs Thus banks are also required to file “suspicious activity reports” on cash deposits of less than $10,000. Based on these reports, if one is merely suspected–not convicted–of structuring, his bank account is seized by the IRS under “civil asset forfeiture” laws, which permits seizures of money or other property suspected of being related to a crime.

Why?

Court keeps cellphone network ‘kill switch’ a secret

The fuss revolves around a policy called Standard Operating Procedure 303, which is “a shutdown and restoration process for use by commercial and private wireless networks in the event of a national crisis,” according to the IT Law Wiki. The Electronic Privacy Information Center (EPIC) brought the suit after San Francisco officials blocked cellphone service to prevent a protest in 2011.

This is a violation of the First Amendment right to Freedom of Speech and Freedom to Assemble. There is no law that overrides those rights. There cannot be, because under the Supreme Court Decision Marbury vs Madison, laws repugnant to the Constitution are automatically null and void. Thus, some official in San Francisco pulled the plug on the cell phone system just because they wanted to. By doing so, along with violation of one of the most basic rights Americans possess, they placed those Americans in emergency situations at risk from the loss of needed communications, plus caused untold economic harm to those Americans using their cell phones for business purposes during the outage. The responsible party needs to be removed from office and made PERSONALLY financially liable for the harm caused to life and property!

To many, the death sentence almost feels like a blot on the city’s collective consciousness.

To the amazement of people elsewhere, Bostonians overwhelmingly opposed condemning the bomber, Dzhokhar Tsarnaev, to death. The most recent poll, conducted last month for The Boston Globe, found that just 15 percent of city residents wanted him executed. Statewide, 19 percent did. By contrast, 60 percent of Americans wanted Mr. Tsarnaev to get the death penalty, according to a CBS News poll last month.

No one here felt sympathy for him.

Woman Told by Airline She Couldn't Return Text From Her Suicidal Husband, Comes Home to Find Him Dead

Karen Momsen-Evers's plane home to Milwaukee from a girls' weekend in New Orleans was about to take off when she received a text from her husband, Andy: "Karen, please forgive me for what I am about to do, I am going to kill myself." Though she desperately tried to respond, Momsen-Evers was told by flight attendants that she needed to put her phone on airplane mode immediately, TMJ 4 reports.

"I begged her, I said I'm sure somebody can make an emergency phone call, I just wanted somebody to go and try to save him," Momsen-Evers said. "Nobody helped." She spent the next two hours crying in her seat. Even when the plane reached cruising altitude and Momsen-Evers explained the situation to another flight attendant, they would not make an exception for her to make an emergency phone call. When the plane landed in Milwaukee, she was finally able to call the police. By the time she got home, she was met by officers who told her Andy was dead.

Khalif Mitchell fined for questioning Holocaust

Khalif Mitchell, 30, a Montreal Alouettes defensive lineman, has been fined the maximum amount allowable by the Canadian Football League (CFL) for social media misconduct.

Mitchell recently posted several Holocaust-related messages through his official Twitter account, @TruthWillFree96.

Obama Calls For Americans To Help Heal The Rifts Between Law Enforcement And Communities

President Barack Obama called on Americans to help "heal the rifts" between law enforcement and communities while giving remarks at the National Peace Officers' Memorial Service at the U.S. Capitol on Friday.

"It takes a special kind of courage to be a peace officer," Obama said. "To be the one people turn to in their most desperate moments. To be willing to run into a dangerous situation, when everyone else is running the other way."

May 15 is Peace Officers Memorial Day, which is part of National Police Week. Obama and others marked the occasion after a year of strained relations between police and citizens around the U.S.

"We can work harder, as a nation, to heal the rifts that still exist in some places between law enforcement and the people you risk your lives to protect," Obama added later. "We owe it to all of you who wear the badge with honor.

A short memo to President Obama: it is all in the training, sir, and giving police the ability to de-escalate a situation, and talk down someone who could be a danger to himself (or herself) and others).

What We Lose When Police Blame Victims For Their Own Deaths

In cases in which charges are not brought against an officer in a police killing, authorities have successfully shifted some blame onto the victim in order to support the assertion that an officer acted legally in using lethal force. The implication is that it isn't the officers' job to stop themselves from killing people -- rather, it is the people's job to not get themselves killed by the officers.

The cases below have all failed to produce criminal charges for the officers involved. But they leave us with a variety of questions that can't be answered simply by having a prosecutor decide that it was the victim -- and definitely not the officer -- who was somehow at fault. Even if we accept the finding that the victims were killed legally, it doesn't answer a more pressing question: Did these people really have to die?

Webmaster's Commentary: 

American law enforcement needs to learn to de-escalate potentially dangerous situations, so that someone who is not in their right mind can be carefully, and humanely, subdued, and get the help they need.

If the training changes, I would almost be willing to bet that the body count from fatal shootings will be substantially be reduced.

Minneapolis cops accused of pepper-spraying 10-year-old boy in the face during protest

A Minneapolis woman accused local police of pepper-spraying her 10-year-old son in the face while accosting a small group of demonstrators protesting excessive force by police on Wednesday night.

The boy’s mother, Susan Montgomery, told the Minneapolis Star-Tribune that the officer maced her son, Taye, after driving up to her and a group of 10 protesters without warning.

“I was thinking, ‘This guy is gonna run us over,'” she said. “People started running. It seemed like he was mad at that point.”

The unidentified officer then stopped his vehicle, she said, before he “just jumped out of his car and started spraying everybody. The Mace just happened. It hit everybody in that area.”

It takes a REALLY MANLY police officer.... to mace a 10 year old kid.

But the problem with police officers EVERYWHERE is that they are trained to view the general public as "the enemy", and one which must be subdued, violently, on sight.
