Halbig v. Burwell: The next big Obamacare case

In brief, these cases claim the IRS has exceeded its statutory authority in authorizing tax credits and cost-sharing subsidies on federal exchanges because the PPACA only authorizes tax credits for the purchase of insurance on an exchange “established by the State under Section 1311.” Section 1311 instructs states to create exchanges. Federal exchanges are established under Section 1321 of the Act.

At one level these cases present a straightforward statutory interpretation question. The text is clear and does not contradict any other provisions in the Act. That would seem to settle the matter.

Why Is Obama Encouraging Illegal Immigration When We Can’t Take Care Of Millions Of Our Own Citizens?

It isn't an accident that our southern border is literally being flooded with illegal immigrants right now. Newspapers in El Salvador and Honduras have been publicizing how easy illegal immigration has become, and even the President of Honduras has said that people are coming to the United States for "Obama's amnesty".

When they arrive, thousands upon thousands of these illegal immigrants are using rehearsed answers that border patrol agents are hearing over and over again. Word has spread that if illegal immigrants claim that they are "fleeing gang violence" that it is more likely that they will be allowed to stay.

What we are witnessing down on the southern border is really unprecedented. It has been estimated that twelve times as many kids are crossing our borders illegally now compared to just a few years ago.

And they just keep on coming.

This is utter madness.

And what is Obama's true "intention" here?

My cynical guess is that this policy has three purposes.

First, to flood the marketplace with ultra-cheap labor, which large corporations, to whom Obama is beholden, love.

Secondly, to create generations of Democratic voters (if elections last much longer in this country)to give a party which has completely deserted and abandoned its alleged core principals, the edge in national elections.

Thirdly, to create a wellspring of revolt among Americans who are legally here, and/or born here, and desperate for some job, any job at all.

Nation-wide riots against illegal immigration would give Obama the excuse for suspending the Constitution and Bill of Rights, and instituting martial law, an action which he would just love to do.

His intention is crystal clear here.

Spanish police arrested eight people on Monday in a raid against a jihadist cell in Madrid, AFP reports. The recruitment network was led by a former Guantanamo Bay inmate.

Police have so far launched 12 raids in the Spanish capital, detaining eight people, and the investigation remains open, Spain’s interior ministry said in a statement.

The Islamic cell found and dispatched recruits for Islamic State of Iraq and the Levant (ISIL) militants based in Syria and Iraq, the ministry said.

Obamacare faces another court threat — and this one could be fatal

The threats to Obamacare just keep on coming……

A case before the U.S. Court of Appeals in the District of Columbia may determine the Affordable Care Act was written in such a way that it prevents the federal government’s HealthCare.gov web site from offering subsidies.

Now such a ruling would have a long way to go before it actually would become enacted — and a lot of legal hoops would have to be jumped through — but such a finding could be a show-stopper for Obamacare. More than 5 million of the 8 million who signed up for Obamacare through the U.S. Department of Health and Human Services’ web site would thus not be eligible for tax credits. Most, presumably, would fall off the rolls of the insured.

A month ago, Glenn Greenwald announced that he was going to publish his biggest story yet: the names of those the NSA has been spying on.

Earlier today, Greenwald tweeted that he would finally publish the story tonight at midnight.

8 hours later, he tweeted:

After 3 months working on our story, USG [the United States government] today suddenly began making new last-minute claims which we intend to investigate before publishing

Many responded that it’s a trap, and that the government is dishonestly and illegally censoring Greewald.

At the same time, Cryptome announced that all of the Snowden documents will be released in July … supposedly in order to avert a war.

“July is when war begins unless headed off by Snowden full release of crippling intel. After war begins not a chance of release,” Cryptome tweeted on its official feed. “Warmongerers are on a rampage. So, yes, citizens holding Snowden docs will do the right thing,” it said.

Michigan awards $90M deal to builder of problem-plagued HealthCare.gov

The State of Michigan has awarded computer contracts worth nearly $90 million to the Canadian firm that built the federal government’s Affordable Care Act website and took much of the blame for its disastrous launch.

Officials in the administration of Gov. Rick Snyder chose CGI Technologies and Solutions, whose parent company is headquartered in Montreal, over three U.S.-based firms.

CGI did not submit the lowest bid. Accenture, a management consulting and technology firm headquartered in New York, offered the lowest price by nearly $5 million, but “CGI provided best value,” Kurt Weiss, a spokesman for the Michigan Department of Technology, Management and Budget, said Friday.

Recently, the EU announced that it is looking into legislation to allow the savings of EU citizens to "be used to fund long-term investments to boost the economy and help plug the gap left by banks since the financial crisis."

Sounds reasonable enough. But why would legislation be needed? It's perfectly legal for people to invest their savings in such ventures now, should they choose to do so.

Let's see what else the EU have to say: They are considering a law "to mobilize more personal pension savings for long-term financing." Mobilise? An odd term to use when discussing privately held savings. It could mean "encourage investment," or it could just as easily mean "confiscate." The former might be okay, but the latter would clearly not.

Obama keeps heat on Republican critics: ‘Even basic common sense ideas can’t get through this Congress’

President Barack Obama used a campaign-style speech in the American heartland Friday to blast his Republican opponents as feckless obstructionists in Congress, saying Washington’s current gridlock “drives me nuts.”

Republicans have become so obsessed with blocking the Democratic president’s every move that he has been forced to use his executive authority to advance priorities like pay fairness, Obama said, dismissing as a stunt a threatened Republican lawsuit against him.

The White House and Republican congressional leaders, notably House Speaker John Boehner, have sparred repeatedly over Obama’s use of executive orders, with Boehner warning this week that Americans “didn’t elect a monarch or king.”

Unfortunately, the only thing this man can do extraordinarily well (assuming the teleprompter is in front of him) - is campaign.

In terms of actually thinking things through to their rational conclusion, the man, and the administration which surrounds him, is absolutely, hopelessly, pathologically incapable of indulging in this discipline.

This is why, under his watch, you had APgate; Bengazhigate;, IRSgate; VAgate; a total security melt-down in Iraq; sponsoring a badly considered putsch in Ukraine, which may have enormous geopolitical consequences with Russia; NSAgate, and Obamacaregate.

And I would be very cautious, were I President Obama, to dismiss Boehner's threat to sue.

And Mr. President, if you want to lift up the middle class, bring back the jobs which used to be the underpinning of a functioning, prosperous middle class in this country.

But you won't, will you, because the large corporations which have supported you want the labor done more cheaply in other countries!!

And your Republican colleagues are just as happy to take the money and not look at the consequences when there are no decent jobs for Americans because it's what their corporate overlords want.

The truth of the business is that Americans understand that they are no longer represented by any part of the American government; it is the corporations, which fund election cycles, which get represented, period, end of discussion.

And because of that understanding, neither party now has any credibility with the American people, whatsoever.

It should be an interesting November election.

Feds Spent $4.8 Billion on Obamacare Exchanges So Far

The federal government has spent nearly $5 billion to establish federal and state exchanges for Obamacare, according to a report by the Congressional Research Service (CRS).

House passes bill to weaken Dodd-Frank and help Wall Street, Koch brothers

The House of Representatives voted Tuesday to water down key parts of the 2010 Dodd-Frank Act, weakening the Commodity Futures Trading Commission’s power to regulate derivatives. The resulting bill helps big banks and the Koch brothers.

The bill reauthorizes the CFTC’s mandate, which expired in October 2013, for five years. It would also reverse the commission’s tough rules on U.S. businesses' swaps with counter-parties abroad, requiring it to draw up a new regime together with the Securities and Exchange Commission. Critics contend that the loosening of regulations could weaken market stability, Reuters reported.

“The purpose of this bill is to remove barriers to business growth that have been imposed by over-reaching and burdensome regulations,” Rep. Michael Grimm (R-NY) said, according to HedgeCo.net.

IRS’s Lerner sought tax audit of Iowa Sen. Chuck Grassley over his wife’s free meal

Lois G. Lerner, the woman at the center of the Internal Revenue Service’s tea party targeting scandal, tried to get her agency to conduct an audit involving a sitting U.S. senator, according to emails released Wednesday by the House Ways and Means Committee.

Ms. Lerner suggested that the IRS look into whether it was wrong for a group to pay for Sen. Chuck Grassley’s wife to attend an event where he was slated to speak. Her suggestion was shot down by another IRS employee who said the arrangement appeared to be legal.

But the email chain, which was turned over to Congress as part of its investigation, raises more questions about Ms. Lerner.

“At every turn, Lerner was using the IRS as a tool for political purposes in defiance of taxpayer rights,” said Rep. Dave Camp, Michigan Republican and chairman of the Ways and Means Committee.

Many South Jersey bridges structurally deficient with little funding for repairs

In the event of an evacuation, the 1,323-foot-long JFK Memorial Bridge is one of only two ways out of Longport.

When inspectors looked at the bridge last year, they were alarmed when they found it had deteriorated severely since its last inspection in 2011.

Atlantic County began a project last summer to fix the issues, including shoring up wooden supports with concrete casings, replacing bridge joints and patching crumbling concrete support beams. It is scheduled to be finished this month.

Beyond the JFK Bridge, though, are several dozen other bridges in South Jersey that are considered structurally deficient, a scary-sounding term that simply means the bridge can’t handle the load it was designed to and is in need of repairs before it deteriorates beyond its usefulness. Dozens more are functionally obsolete, according to federal bridge data, meaning they’re too old to meet newer guidelines.

Despite having reported the discovery of Dr. Haut's signed report confirming the existence of a second wound to Vincent Foster's neck, radio host Rush Limbaugh to this very day refers to Vincent Foster's death as a suicide.

Even Matt Drudge, when presented with the FBI records proving that the FBI fraudulently manufactured Lisa Foster's recognition of the gun found at Fort Marcy Park, refused to get involved, opting instead for a story accusing Sidney Blumenthal of domestic violence (for which Drudge was then sued).

Norman Cillo, an Army veteran who worked in intelligence and a former program manager at Microsoft, argued it is very difficult to lose emails for good and laid out six reasons why he believes Congress is “being lied to” about the Lerner emails:

1. I believe the government uses Microsoft Exchange for their email servers. They have built-in exchange mail database redundancy. A state judge has ordered an opponent of state Sen. Ben Kieckhefer of Reno to pull a TV ad that says the Republican incumbent supported Democratic U.S. Senate Majority Leader Harry Reid in his 2010 race against Republican Sharron Angle.

Washoe County District Judge Patrick Flanagan granted Kieckhefer’s request for a preliminary injunction on Friday night, saying the incumbent is “likely to suffer irreparable injury to his career and reputation” from GOP challenger Gary Schmidt’s ads.

The ruling was handed down only four days before Tuesday’s primary election in Nevada.

All of a sudden, the lockstep defense of Obama by Democrats starts to make sense. Obama's latest PR stunt, bringing back Bergdahl to offset the damage from the VA scandal, has blown up in his face with the revelation that Bergdahl was a deserter and defector. Standing with Obama on this issue mere months before the November elections is not going to help the re-election chances for Democrats. But with Obama in his last term of office, it doesn't make sense to rick ones own career to protect him.

But it makes perfect sense if they are protecting Hillary for 2016.

As things stand, Hillary looks to handily win the 2016 Democratic nomination. And short of bringing back Ron Paul, the GOP is unlikely to find a candidate who can keep Hillary from the White House.

But if Obama is impeached, or resigns, or removed under the Twenty Fifth Amendment, then Joe Biden steps into the Oval Office and enters the 2016 primaries already being the President, an advantage that could easily sweep Hillary off to one side. If Biden replaces Obama more than half way through Obama's second term, then he is legally eligible to run for two terms on his own, taking him to 2024, by which time Hillary will be too old to run again.

So I think what is going on is that the Democrats who support Hillary are trying to protect Obama in order to protect her chances for 2016.

FLASHBACK - Vietnam MIAs: Ghosts Return to Haunt McCain and the US Press

The briefing took place in 1973, right before the final peace agreement between the US and Hanoi. What the Vietnamese general told the Russians was that his government was intent on getting war reparations, $3.25 billion in reconstruction money, pledged by the US in peace negotiations headed on the US side by Henry Kissinger. The general told the Russians that Hanoi would hold back a large number of POWs until the money arrived. It seems the Vietnamese had successfully used the same tactic with the French, to elicit promised funds, after which POWs were transferred.

Obama is on TV now, justifying his bypass of Congress to trade five Taliban officials from Guantanamo for Bergdahl, using as his justification the "sacred principle" that we do not leave anyone behind.

This is, of course, nonsense. The US abandoned 600 POWs in Vietnam to avoid paying $3.25 billion in war reparations.

This trade for Bergdahl was another desperate PR stunt by the White House to offset the VA scandal, and with Bergdahl's being revealed as a deserter and defector, has become a scandal in itself.

South Dakota Candidate Charged in Election Case

South Dakota authorities on Wednesday arrested defeated U.S. Senate candidate Annette Bosworth and charged her with multiple counts of perjury and filing false election documents, saying she fraudulently attested to gathering voter signatures when she was really on a Christian mission trip to the Philippines.

South Dakota Attorney General Marty Jackley charged Bosworth with six counts of perjury and six counts of filing false documents related to election campaign laws. The arrest warrant was served a day after Bosworth lost the Republican primary with just 6 percent of the vote.

Onward global army ... maybe sooner than later?

The beauty, in the eyes of some, is that when things get really bad for the general population and more and more uprisings occur, an international army will better be able to step in and do crowd control (you know, keeping the peace) than a local army would, local soldiers being possibly reluctant to shoot real bullets at their own people. That may also be one of the reasons for the partnership with the US Northern Command - so that US troops could step in to put down a Canadian uprising, and vice versa.

Last, but still worth considering: maybe recruitment centres won't be needed if a draft is imposed, which of course would only occur if the predicted WWIII is not just a conspiracy fantasy.

I'm also getting the feeling our economy is going to tank (further), which means there will be lots of unemployed youth with no place to go but the military.

Georgia : GYLA Says Decision on Ivanishvili Citizenship 'Illegal'

Tbilisi-based legal advocacy group, Georgian Young Lawyers’ Association (GYLA) said in a statement on April 5, that the Civil Registry Agency’s decision to refuse Bidzina Ivanishvili in citizenship through naturalization “is not in line with provisions of the Georgian legislation.”

Saakashvili still has until the end of today to overturn the Civil Registry's recommendation that Ivanishvili's application be refused. If he doesn't then he is guilty of making the law up as he goes along...

“If at the time of undergoing naturalization process, an applicant has a foreign citizenship, there should be this applicant’s declared will that in case of entering into the Georgian citizenship, he/she will renounce citizenship of any other country,” GYLA said.

Before applying for citizenship through naturalization, Ivanishvili on December 29, 2011 submitted to the French embassy in Tbilisi a request for launching procedures for his withdrawal from the French citizenship. One of his lawyers, Shalva Tadumadze, said at the time that the move did not mean that Ivanishvili would now become a stateless person; Ivanishvili’s French citizenship would only be revoked in case of gaining the Georgian citizenship, the lawyer said.

“The Civil Registry Agency was aware about [Ivanishvili’s] will that he would have renounced his French citizenship in case of gaining Georgian citizenship. Accordingly, in this particular case, the goal of the law that a person should be only a Georgian citizen after receiving Georgian citizenship through naturalization would have been achieved,” GYLA said.

GYLA also cited the January 30, 2009 presidential order number 39 and a citizenship application form to back its claim that the Civil Registry Agency’s decision was not in accordance to the law. The group said that a citizenship application form contains one line in which an applicant is required to state that in case of granting Georgian citizenship he/she agrees to renounce citizenship of a foreign country and has to indicate that country.

GYLA says this formulation in the application form “unambiguously” shows that an applicant has the right to renounce foreign citizenship only after entering into the Georgian citizenship.

“The goal of the Georgian legislation is that after gaining Georgian citizenship through naturalization, a person should not remain a citizen of any other country. In this particular case, this goal was easily achievable – the Georgian President could have issued a decree on granting Georgian citizenship to a person, which would have been enforced not immediately (to avoid that a person would become a citizen of two countries simultaneously), but only after receiving an official document from the relevant French authorities on satisfying [Ivanishvili’s] application on renouncing French citizenship,” GYLA said.

Georgia : Ivanishvili Still Confident in Regaining Citizenship

A day after being refused in citizenship through naturalization by the Civil Registry Agency, Bidzina Ivanishvili, leader of an opposition Georgian Dream coalition, said he was still confident that he would regain his Georgian passport.

He said the Civil Registry Agency’s decision was so “feeble” and “senseless” that it was not even worth of commenting.

“We will boost the Georgian people’s spirit; I have a concrete plan,” he said. “We will gradually force the authorities to back-off from violence… I promise that we will bring on a situation by this fall wherein the Georgians won’t have any fear and they will freely turn out [at polling stations] and make right choice and we will say no to oppressor Saakashvili,” Ivanishvili said.

Ivanishvili also said on April 5, that decision of the Civil Registry Agency showed President Saakashvili’s “fear” towards a strong political opponent.

“Saakashvili is so afraid, he is in such agony, that he is not even capable to look several days ahead, otherwise he could have seen very well an outrage of the Georgian and international community towards his illegal actions,” Ivanishvili said.

In his comments Ivanishvili hinted that after coming into politics he was trying to provoke President Saakashvili on such actions that would have demonstrated, as Ivanishvili put it, “his real face.”

“I’ve been trying in recent six months to act in a way, to address him in a way that would have maximally promptly and well demonstrated his real face… I think we have managed it very well and I think no one in Georgia has an illusion about who this man [Saakashvili] is and about the fact that the country is ruled by a single man and everything depends on his mood,” Ivanishvili said.
